Secondly, the overturning of the Federal ban on sports betting by the Supreme court allowed each individual state to dictate their position on sports betting. This gave momentum for North Carolina to include sports betting as a tribal Class III game.
Surprisingly Daily Fantasy Sports (DFS) was struck down from the proposition of sports betting. It was deemed to be online or mobile betting, which is not permitted. It was also deemed to be a game of luck, and NOT a game of skill and therefore under state law is defined as gambling. Nevertheless, it was interesting to note that the senate admitted that DFS is being offered and played by North Carolina Players in an unregulated and unlicensed framework.
